CONDITIONS OF PARTICIPATION IN PERFORMANCES ORGANISED BY POLONIA - THE TOURISTIC - COMMERCIAL OFFICE

I. CONCLUDING THE AGREEMENT

1. Concluding the agreement in an event organised by the BTH "POLONIA" becomes binding
after filling in and signing by an applicant the Agreement - Application and paying about
30% of the cost of the event. The adjustment of the entire payment should be executed latest
up to 30 days before the beginning of the event. Failing to pay it in the settled time limit is
understood as resignation from the event, unless the organiser accepts changing the time limit
to execute the entire payment. Only authorised persons can sign orders and applications of
workplaces.
2. The office requires a possibility to withdraw the event because of reasons independent on
them (decisions of authorities, acting of the Force Majeure, quantity of participants less than
the necessary minimum etc.) without bearing any additional own costs.
3. The participant is obliged to inform the Office about changing the name, address, the phone
number and other essential changes and facts influencing the formalities connected with
departure of the Participant. The information must be handed over to the Office in the time
limit enabling executing the necessary formalities.
4. The price can be changed only in the case of the circumstances specified in the Statute on
touristic services dated 29. 08. 1997, the article 17, it means a) increase of the cost of
transportation, b) increase of customs duties, taxes or fees due for such services like airport
or handling in sea and ports, considerable increasing of currencies rates of exchanges.

II. RESIGNATION FROM THE EVENT

1. Resignation from the event can be executed in a written form only. Date of resignation is understood as the day of its delivering to the office.
2. The participant can receive the return of the entire payment in case when the resignation or impossibility for taking part in the event arises because of reasons for which the office is responsible. These reasons are: a) change of essential conditions (the price, time limit, allowances specified in the agenda), b) withdrawing the event.
3. The costs borne by the Participant in case of resignation from the event:

a) the handling fee amounting USD 50,- per person in case when the resignation took place in the time limit earlier than 30 days before beginning the event.
b) 30% of the event amount in the case when the resignation took place between 29 and 21 days before the date of the beginning of the event.
c) 50% of the event amount in the case when the resignation took place between 20 and 7 days before the date of the beginning of the event.
d) 100% of the event amount in the case when the resignation took place in the time limit shorter than 7 days before the beginning of the event.

4. BTH "POLONIA" does not return the money because of performances not used by the customer because of their fault. The above refers also to the cases when the border authorities will not give a permission to enter a country.

5. The organiser reserves the right to limit the responsibility for not executing or its undue executing of this agreement in accordance with the Statute on touristic services dated 29. 08. 1997 in the cases defined in the article 18, item2:
a) regulations binding in the country of staying, in relation to services performed by the local persons providing services,
b) regulations of the international agreements,

c) specific regulations - on condition the univocal stipulation in the agreement.

III. EXECUTION OF THE AGREEMENT AND CLAIMS
1. 1. BTH "POLONIA" accepts the responsibility for accurate preparation of the event. In case when changes will take place during the event because of the reasons independent on BTH "POLONIA", the Office is obliged to organise the substituting performances. In case of lack of such a possibility, the participant shall receive the value of the non-executed performances.
2. BTH "POLONIA" is not responsible for an event shortcoming arisen because of the reasons independent on them (for example: the atmospheric conditions, the decisions of governments, closing a beach, switching off the current, closed museums etc.) and also for these for which participants are responsible.
3. The participant is obliged to observe the customs and the foreign currency regulations and usages binding in a given country.
4. The customers are responsible for damages caused by their own fault and the fault of persons being under their care and are obliged to repair them or to cover the coast of repairing.
5. Any claims referred to services shall be submitted in the written form only immediately, not later than 7 days after ending of the event. The basis for consideration of the claim is the written submitting any remarks during the event and confirming them by the pilot (a resident, an educator, a hotel management).
6. BTH "POLONIA" considers claims within thirty days and answers in the written form
7. The agreement has been concluded in accordance with the Statute on touristic services dated 29. 08. 1997 (the Journal of Laws No 133).
8. Any disputes arisen because of executing this agreement will be determined amicably or by the proper Szczecin court.
IV. FINAL PROVISIONS.
All affairs not adjusted by these Conditions of Participation will be concluded basing on regulations included in the Statute on Touristic Services dated 29. 08. 2003 (with latter alterations and its executing acts).
